Terms and Conditions
Argish LLC accepts bookings for tours in Russia. Argish LLC will organize travel in hard-to-access parts of Russia for its clients. The following conditions apply:
- Expedition contract
The contract is between Argish LLC and the client (hereinafter referred to as ‘you’), this being any person or organization using Argish LLC’s services. The contract and any issue arising from it are subject to Russian law and the exclusive jurisdiction of the Russian Courts.
Argish LLC guarantees to:
- Organize all accommodation, transport and activities as described on the itinerary sent to you by email, unless force majeure circumstances necessitate changes to the itinerary.
- Provide a guide who speaks the language that you agreed on and who will meet you at the place and time that you agreed on. The guide will accompany you until the place and time that you agreed on, apart from in circumstances outside their or Argish LLC’s control, such as illness or injury. In the case of illness or injury, as suitable as possible replacement guide will be found as soon as possible at no extra charge.
- Organise all permits and letters of invitation necessary for your trip.
- Give advice in good faith about the best time of year and best region to visit, weather, daylight hours, and any other information required in order for clients to achieve the goals of their trip. This advice, however, is not a guarantee and is in no way legally binding.
- Do its best to help you achieve any specific trip goals you have.
- Booking and payment
To reserve the dates of your trip Argish LLC requires a non-refundable deposit of 35% of the total price of the trip. Argish LLC’s services are sold on a “first come first served” basis: until the contract is signed and the deposit is paid, Argish LLC has not promised its services to you. The booking is accepted as soon as the deposit is paid and the contract signed and returned.
The balance payment must be paid not later than 2 months before the start date of the trip.
Payments should be by bank transfer. Argish LLC’s account details will be included on the invoice.
If you are traveling to an area that requires special permits, you must also send scanned copies of your passport at least 2.5 months before your trip’s start date, or 4 months if traveling to Chukotka. Failure to miss this deadline may mean that you will not be able to get your permit in time for your trip. You agree that Argish LLC will be held liable for trip cancellation due to failure on your part to provide the above mentioned documents on time to get the necessary permits. You agree that in the case of failure on your part to send the abovementioned documents to Argish LLC on time then your deposit will not be refunded.
- Travel to the start point of the trip
Unless otherwise stated travel from your home country to the start point of the trip is your responsibility. The start point of the trip is the place where you meet your guide.
- Changes and cancellation by you
You will receive no refund of your deposit if you cancel your trip after reserving dates. If you decide you want to change the dates of your trip, Argish LLC will make every effort possible to accommodate your wishes at no extra charge. However, if no other dates are available by the time you decide to change your trip dates, your deposit will not be refunded.
If you cancel after paying the balance but before the beginning of your trip, you will be refunded 50% of the balance.
If you cancel or shorten your trip after it has started, no refund will be paid. Cancelling or shortening can mean returning to Moscow (or other trip start point in Russia) earlier than planned for any reason at all; returning to a village or town from a nomad camp earlier than planned for any reason at all; returning from a village to a regional capital earlier than planned for any reason at all; making any other changes to the itinerary that have not been explicitly agreed to by Edward Adrian-Vallance, managing director of Argish LLC.
If you decide to extend your trip before or during the trip, or make any other alterations to the itinerary, this can be done only with the express permission of Edward Adrian-Vallance, managing director of Argish LLC. Your guide, if it is not Edward Adrian-Vallance, does not have the authority to shorten or extend a trip, or make any other alterations to the itinerary. If you alter or extend your trip in any way or for any reason without the explicit permission of Edward Adrian-Vallance, ALL further travel arrangements and costs will be your own responsibility, including transport in the area, transport back to Moscow, accommodation, etc. Altering or extending the trip without the explicit permission of Edward Adrian-Vallance releases Edward Adrian-Vallance, your guide and Argish LLC from responsibility to complete your trip and get you back to Moscow.
- Changes and cancellation by Argish LLC
Changes and flexibility:
Argish LLC makes every effort to provide the services advertised. However, due to the nature of exploratory adventure / expeditions and travel with Arctic nomads, Argish LLC, your accompanying guide and any locals who have been hired or paid for the trip by Argish LLC reserve the right to make changes to the expedition itinerary and activities, if required by circumstances beyond their control or because of the necessity for flexibility. These changes could include: accommodation and transport, trip length, trip location, activities involved in the trip, drivers, guides and interpreters used, and so on. You understand and acknowledge that Argish LLC, your guide and any locals working on the trip are under no contractual obligation to strictly follow the stated itinerary and activities. You understand particularly that in remote parts of Russia. particularly in winter, uncontrollable circumstances may delay you or cause you to lose days from your itinerary. These circumstances would usually be bad weather that makes travel impossible for a short period of time or any circumstances caused by being in a remote area with poor infrastructure.
If Argish LLC or your guide is forced to change or cancel a trip after it has started because of events and situations outside his control – “force majeure” – no compensation will be paid. Force majeure includes, but is not limited to war or threat of war, terrorist activity, strike, natural disaster, fire, adverse weather conditions, epidemics and health risks. In case of changes or cancellation of the planned trip due to force majeure, Argish LLC will make every effort to provide you with a similar alternative itinerary but do not guarantee it.
- Visiting nomad camps
If you book a trip involving a trip to a nomad camp, Argish LLC guarantees to send you to a camp of genuine, working, nomadic reindeer herders. You understand that these are real, working nomads whose everyday lives you are here to share in and observe. Neither they, Argish LLC nor your guide are obliged to do anything especially for you, put on any shows or do anything that they would not usually do in their daily lives.
Argish LLC can advise on, but not make any guarantees relating to:
- The number of reindeer at a camp. This could be anything from 100 to several thousands.
- The number of chums or tents at a camp. This could be anything from 1 – 5.
- The number of people at a camp. This could be anything from 2 – 30.
- When or how often the nomads will migrate. Sometimes they migrate every day for four days in a row, sometimes they do not migrate for two months.
- What age / gender of people will be at the camp. Usually there are children but not always.
Argish LLC can use its in-depth knowledge and experience to make educated guesses in relation to the above points 1 – 5, but he cannot make any guarantees. People come and go from camps, chums separate off and the inhabitants live separately, other chums come and join up, reindeer are born and die, so although Argish LLC will provide you with the most accurate advice and estimates possible they are in no way legally binding. Clients understand that nomads move constantly and are very unpredictable, so any correspondence between you anyone from Argish LLC relating to the above points 1 – 5, or any advice relating to them, is made in good faith but is not legally binding.
- Travel Insurance
It is a mandatory requirement for you to have travel insurance for the duration of your stay in Russia that provides adequate insurance cover and protection for medical expenses, injury, death, emergency air evacuation, emergency repatriation, cancellation etc. It is a mandatory requirement for you to ensure that the insurance does not exclude the type of activity included or likely to be encountered on the trip and for you to ensure that the insurance is valid in the area where the trip will take place. You must carry your policy with you throughout the trip.
- Special requests
Argish LLC will try to accommodate special requests where possible. They must be received in writing as part of the booking form.
- Preparing for the trip
Equipment and belongings:
A list of equipment and clothing required for the expedition will be provided and forms part of the booking confirmation. Argish LLC and your guide reserve the right to ask you to leave the trip if you are considered not to be equipped appropriately. No refund will be provided in this situation. You are responsible for your equipment and other personal belongings. Neither Argish LLC nor your guide can be held responsible for any damage or loss.
You are responsible for obtaining and being in possession of a passport that is valid for the duration of the trip and six months afterwards and sending a scanned copy to Argish LLC not less than 2.5 months before the trip start date, or 4 months before if travelling to Chukotka.
Visas: You are responsible for obtaining and being in possession of a valid Russian visa, if required for your nationality. Argish LLC will provide you with the letter of invitation for your visa.
You are responsible for arranging any vaccinations and possessing vaccination certificates as required.
You are responsible from bringing an adequate medical kit with you.
Information about the above and other related matters to do with preparation for the tour can be given in good faith but without responsibility on the part of Argish LLC.
- Participating in trip activities and the trip itself
Fitness and health:
Some of our trips require a reasonable level of fitness & health. You may, for example, need to walk through the snow in heavy reindeer fur clothing. Also, anyone with back and neck problems may find sledging, snowmobiling or long trips on ice roads tough.
By booking a trip through Argish LLC, you agree that your level of fitness is enough to be able to take part in the activities proposed on the itinerary. Argish LLC is not responsible for sickness, injury or death caused by the fact that a client was not fit enough to visit the places or take part in the activities proposed on the itinerary.
You are responsible for arriving in good time at the start point of the trip as stated on your itinerary. If you miss the subsequent departure from the start point you will not be entitled to a refund or alternative trip, although Argish LLC and your guide will make every effort to find you alternative transport and get you back on the itinerary. Any extra costs involved will be your own responsibility.
Local culture and customs:
You agree to respect and comply with the culture, customs and laws of the people of Russia. You agree to behave well, act politely and treat locals and travel companions with respect. If you fail to do this, your guide will give you a warning. If you continue to fail to do this, you will receive an official warning from Argish LLC in writing by email and over the phone. If you continue to fail to comply, Argish LLC and your guide reserve the right to cancel or shorten your trip. In this case, no compensation will be paid and any expenses incurred in returning to your home country must be met by you.
Authority on the trip:
By booking with Argish LLC you agree that the instructions and decisions of your guide and of locals working on your trip will be final on all matters that relate to the safety and wellbeing of you, your guide and those around you. You agree to abide by the authority of your guide and locals working on your trip.
- Safety and Risks
Argish LLC accepts your booking on the understanding that you acknowledge and appreciate the nature of expedition / adventure travel in remote areas, and that it may involve a significant amount of personal risk. You hereby assume all such risk and do hereby release Argish LLC and everyone in its employ from all claims and causes of action arising from any damages, loss, injuries, sickness or death resulting from these inherent risks. Neither Argish LLC nor anyone in its employ is responsible for clients’ health, safety, possessions or lives.
Whilst Argish LLC and your guide will undertake all reasonable efforts to assess risks and to ensure clients’ safety, it is agreed that you participate at your own risk.
All information provided by Argish LLC is protected by copyright and may not be reproduced or transmitted in any form without written permission.
Unless you notify otherwise, Argish LLC may use any images of you from the expedition for marketing purposes without charge.
- Data Protection
You agree that Argish LLC can pass on your details to third parties when required to do so in relation to matters regarding the tour.
